What are the costs involved?

  • Employers are often required to pay $1,000 for a Labour Market Impact Assessment. However, we can usually match you with programs that avoid this fee.

  • Recruiting Costs range anywhere from $500 to 25% of the value of the worker's salary.  We can show you how to avoid these costs as well.

 

Is there a guarantee to make sure your new employee works out?

  • Yes!  You have 90 days to ensure they are a good fit for your organization.

Can we interview candidates before hiring them.

  • Yes.  We will arrange to have virtual interviews with you .


How long does it take?

  • Typically, hiring a worker from abroad takes 6 months from the time the request is submitted to when they start work.

  • If the worker is already in Canada on a visitor visa, this time can be shortened by up to 3 months.

 
Will the worker be able to communicate effectively in English?

  • Yes, English proficiency testing is conducted for each candidate.

  • You will also have the opportunity to virtually interview each person to assess their skills.

 
Do I need to provide housing or flights for the workers?

  • In 99% of cases, you are not required to provide these.

  • The only case where this is required is if you are hiring agricultural workers.

WHAT ARE THE STEPS INVOLVED WITH HIRING FOREIGN WORKERS?

To hire a temporary foreign worker in Canada using the Labour Market Impact Assessment (LMIA) programs, here are the general steps that an employer needs to take:

1. Determine the need: Assess your labor needs and determine if hiring a foreign worker is necessary and justifiable for the position you are trying to fill.

 

2. Apply for an LMIA: Submit an LMIA application to Employment and Social Development Canada (ESDC). This application demonstrates that there is a genuine need for a foreign worker and that no Canadian citizens or permanent residents are available to fill the position.

 

3. Advertise the position: Advertise the job vacancy in Canada for a specific duration and through appropriate channels as required by ESDC. This step aims to demonstrate that reasonable efforts have been made to hire Canadians or permanent residents.

 

4. Obtain a positive LMIA: If ESDC determines that there are no qualified Canadians or permanent residents available for the job, they may issue a positive LMIA. This document confirms that hiring a foreign worker will have a positive or neutral impact on the Canadian labor market.

 

5. Offer the job to the foreign worker: Once you receive a positive LMIA, you can make a formal job offer to the foreign worker you intend to hire. The job offer must include details such as job description, wages, working conditions, and the start and end dates of employment.

 

6. The foreign worker applies for a work permit: The foreign worker will need to apply for a work permit from Immigration, Refugees and Citizenship Canada (IRCC) after receiving the positive LMIA and job offer.

 

7. Work permit approval: If the work permit application is approved, the foreign worker will receive a work permit that allows them to work in Canada for the specified period and with specific conditions.

It's important to note that the LMIA process can be complex, and there may be additional requirements or variations depending on the specific program or stream you are applying under. It's recommended to consult with our immigration lawyers and immigration consultants who can provide guidance tailored to your specific situation and ensure compliance with the current immigration regulations.

​To come to Canada as a temporary foreign worker through the LMIA programs, the foreign worker needs to follow these general steps:

​

1. Job offer and LMIA: The foreign worker needs to secure a job offer from a Canadian employer who has obtained a positive Labour Market Impact Assessment (LMIA) for the position. The employer will provide the foreign worker with a copy of the positive LMIA.

2. Gather required documents: The foreign worker needs to gather the necessary documents, which may include a valid passport, educational credentials, work experience letters, language test results (if applicable), and any other supporting documents required by the specific work permit category.

​

3. Work permit application: The foreign worker must complete the work permit application, which can be done online or through paper forms, depending on their country of residence. The application should include the required forms, documents, and the appropriate fee.

​

4. Submit application to IRCC: The completed work permit application and supporting documents must be submitted to the appropriate visa office or visa application center of Immigration, Refugees and Citizenship Canada (IRCC) in the foreign worker's country of residence. The application should be accompanied by the required fee payment.

5. Medical examination and police certificates: In some cases, foreign workers may be required to undergo a medical examination to ensure they meet the health requirements. They may also need to provide police certificates to demonstrate good character and security clearance.

6. Wait for application processing: The application will be reviewed by IRCC. The processing time can vary, so the foreign worker should regularly check the status of their application through the online portal or by contacting IRCC.

​

7. Receive work permit approval: If the work permit application is approved, the foreign worker will receive a letter of introduction from IRCC. This letter will need to be presented to a border officer upon entry into Canada.

8. Entry into Canada: The foreign worker can travel to Canada and present the letter of introduction to the border officer. The officer will make the final decision on granting the work permit and will issue the work permit document, allowing the foreign worker to work legally in Canada.

It's important to note that there may be additional steps or requirements depending on the specific circumstances, such as the type of work permit, and any applicable visa requirements.
